Contested Divorce

Contested divorces are those in which both parties are unable to reach an agreement on the terms and conditions of their divorce. Common areas of disagreement include, but are not limited to, child custody, child support, maintenance, and division of marital assets. Due to their complexity, contested divorces require an experienced attorney who can inform their client of his or her rights and to ensure he or she is fully protected.

Uncontested Divorce

Uncontested divorces are those in which both parties are able to reach an agreement on all terms and conditions of their divorce. In contrast to contested divorces, uncontested divorces allow the parties to decide for themselves the appropriate resolution for any property and debt, and what arrangements work best for the custody, care, and support of their children. Uncontested divorces can often be handled quickly and at a fraction of the cost of a contested divorce.

Child Custody

Child custody and parenting schedules are often the most contentious and emotionally challenging areas in family law. Kentucky law provides that custody and parenting schedule determinations are to be made in the best interests of the child. Our attorneys have experience litigating all aspects of custody cases.

Child Support

Child support may be ordered through a divorce proceeding, or through a circuit or paternity proceeding when the parties were never married. In Kentucky, child support is typically determined by the Kentucky Child Support Guidelines. Factors taken into consideration include the gross income of the parties, the number of children, prior born children, the cost of childcare, and the cost of medical insurance.

Maintenance

Maintenance, or alimony, is a court order that one spouse provide financial assistance to the other. Maintenance may be awarded on a temporary or permanent basis. The court assesses a number of factors to decide whether maintenance should be awarded and the amount of money and length of time maintenance should be received.
